QUALIFICATIONS OF CANDIDATES

In order to run for municipal council, a candidate must be:

  • a resident of the municipality or a non-resident owner or tenant of land in the municipality or the spouse of such non-resident owner or tenant;
  • a Canadian citizen;
  • at least 18 years old;
  • not legally prohibited from voting; and
  • not disqualified by any legislation from holding municipal office

In order to run for a school board, a candidate must be:

  • a resident in the area of jurisdiction of the board;
  • a Canadian citizen;
  • at least 18 years old;
  • eligible to be an elector of that school board for which the person is a candidate (e.g. if seeking office for a French-language separate school board, you must be a French-language separate school elector);
  • not legally prohibited from voting; and
  • not disqualified by any legislation from holding office.

TERM OF OFFICE

The term of office is four years, beginning on December 1 after the election. However, the term of office for a person elected in a by-election to fill a vacancy is the remainder of the term for that office.

In order to raise campaign funds or incur campaign expenses, you must first be nominated. You can only be nominated for one office at a time.

HOW TO BE NOMINATED

Nominations for the positions listed must be made on the Form 1-Nomination Paper available at Town Hall, or downloaded from this site and brought to Town Hall during normal office hours (8:30 a.m. - 4:30 p.m.) between January 4th, and September 10th, 2010 (Nomination Day).  Note that the deadline on Nomination Day is 2:00 p.m.

The required filing fee of $100.00 (cash, certified cheque or money order made payable to The Town of Perth must accompany the signed form.  Full details on the procedures to be followed may be obtained from the Returning Officer. The filing fee for Head of Council position is $200.00.

1) Obtain and complete a Form 1-Nomination Paper-Jan2010 available by downloading the form, or at Town Hall.

2) Nomination forms must be filed, either in person or by your agent, with the Returning Officer at Town Hall between Monday, January 4, 2010 to Thursday, September 9, 2010 from 8:30 a.m. and 4:30 p.m., and Friday September 10, 2010, up to 2:00 p.m. You can only file a Nomination Paper in person or by an agent.  It cannot be filed electronically or by fax.

3) Complete and sign a Form-EL18-Declaration of Qualifications-Council in the presence of the Returning Officer.

4) Pay the prescribed nomination filing fee of $200 for office of the Mayor or $100 for all other offices (Deputy Mayor or Councillor) at the time of filing the Nomination Paper (cash, certified cheque or money order payable to The Town of Perth). You will be entitled to a refund of the filing fee if you are elected, or receive two per cent of the votes cast for the office or if you withdraw your nomination.  Please note a campaign bank account is required of all candidates.

Your Nomination Paper will be examined by the Returning Officer on Monday September 13, 2010, and either certified or rejected. You will be required to show proof of your identity and qualifications prior to certification.

If you decide that you want to withdraw from the election, you must notify the Returning Officer in writing by 2 p.m., on Friday, September 10, 2010. You are still required to submit a financial disclosure covering the financial transactions made up to the point at which you withdrew.

To ensure impartiality, the Returning Officer does not participate in this process.
